ARTICLE 2. INTELLECTUAL PROPERTY

This site is owned and operated by Breteuil. All elements composing the Site, including trademarks, logos, domain names and other distinctive signs appearing on the site www.breteuilhomes.com (hereinafter "the Site"), are protected by current legislation on intellectual property and copyright, and belong to Breteuil or are subject to a licence to use.

ARTICLE 3. PERSONAL DATA PROTECTION

Breteuil attaches great importance to the protection and respect of the privacy and personal data of users of its website (hereinafter the "Site").

Breteuil is committed to implementing adequate measures for the protection, confidentiality and security of Personal Data in accordance with the regulations in force in France and in the European Union, in particular the General Data Protection Regulation EU 2016/679 of 27 April 2016 and the national law rules adopted for its application.

We inform users of the practices and processing inherent in the collection and use of Personal Data by Breteuil as data controller.

It is specified that by browsing the Site, users accept these conditions.

3.1. PERSONAL DATA COLLECTED

Users may be required to provide their Personal Data in digital format when using the Site.

3.1.1 PRINCIPLES APPLICABLE TO THE COLLECTION OF PERSONAL DATA

In general, users can browse the Site without necessarily needing to communicate Personal Data to Breteuil.

Breteuil only collects the Personal Data necessary for the processing it implements and ensures a high level of protection. In this respect, the processing requiring data collection is as follows:

Property valuation requests

Executing a mandate entrusted by users

Participating in surveys to improve the relationship and the customer experience

Sending newsletters, informational or commercial alert emails and/or SMS

This Personal Data is then retained for the time necessary to fulfil the users' request. In the absence of concrete fulfilment, it is deleted within the timeframes recommended by the CNIL, i.e. three years from its collection by the Site or the last contact from the user, subject to legal possibilities and obligations regarding archiving, data retention obligations and/or anonymisation.

3.1.2 SITE USER BROWSING INFORMATION

When using the Site or certain services related to the Site, certain data is automatically collected such as: IP address, browser software reference, browsing data (date, time, content viewed, search terms used, etc.), operating system references.

Among the technologies used to collect this information, Breteuil may use "sessions" or "cookies" that store each user's data in memory or on their hard drive.

Users may also object to the recording of cookies by using the corresponding features on their browser. However, Breteuil draws users' attention to the fact that, in such a case, access to certain services on the site may be impaired.

Data collected during browsing is deleted when the user's browser closes, or, where applicable, within a maximum of 26 months from its collection.

GOOGLE ANALYTICS COOKIES

For reasons related to the technology used by Google Analytics, visiting the Site may, where possible, result in the use of a cookie installed on users' terminal equipment for statistical analysis and audience measurement purposes. In this context, your IP address is used for geolocation purposes without resulting in information more precise than the city, it being specified that this IP address will be deleted or anonymised once geolocation has been performed. The use of such cookies is strictly limited to the production of anonymous statistics by Google. The retention period for these cookies is limited to 26 months.

Site users acknowledge having been informed of this practice and authorise Breteuil to use it.

3.2. LEGAL BASIS FOR THE COLLECTION AND PROCESSING OF PERSONAL DATA

Personal Data is processed by Breteuil in cases authorised by current regulations and under the following conditions:

Obtaining free, specific, informed and unambiguous consent from users for the processing of their Personal Data (it is specified that for minors under 18, consent must be given by the legal representative)

Collection of Personal Data necessary for the execution of users' requests

Compliance with legal and/or regulatory obligations incumbent on Breteuil (such as the fight against fraud and corruption)

Protection of Breteuil's legitimate interests (such as the protection of the security of its IT network).

3.3. RECIPIENTS OF COLLECTED PERSONAL DATA

Only authorised personnel of the group and Breteuil's service providers may have access to the collected Personal Data and process it, without prejudice to their possible transmission to bodies responsible for a control or inspection mission in accordance with current legislation and/or regulations or in order to respond to a judicial or administrative decision.

Authorised personnel are subject to a duty of discretion.

Breteuil undertakes not to market the collected Personal Data to third parties.

3.4. TRANSFER OF PERSONAL DATA

Personal Data collected from Site users is stored exclusively in Europe and is not transferred outside the European Union.

In the event of recourse to affiliates or service providers located outside the European Union, Breteuil undertakes to verify that appropriate measures have been put in place so that users' Personal Data benefits from an adequate level of protection.

3.5. DATA SECURITY

Breteuil collects and processes users' Personal Data with the utmost confidentiality and in compliance with applicable laws. Users are protected against unauthorised access, modification, disclosure or destruction of their Personal Data.

When the disclosure of Personal Data to third parties is necessary and authorised, Breteuil ensures that these third parties guarantee the same level of protection for the Personal Data concerned as that offered by Breteuil, and requires contractual guarantees so that Personal Data is exclusively processed for the purposes accepted by users, with the required confidentiality and security (in particular through standard clauses of the European Commission, Binding Corporate Rules ("BCR") or the EU-US Privacy Shield).

Breteuil implements technical and organisational measures to ensure that the storage of Personal Data is secure for the duration necessary for the pursuit of the intended purposes.

Users' attention is drawn to the fact that no transmission or storage technology is entirely infallible.

Furthermore, in the event of a confirmed breach of Personal Data likely to pose a high risk to users' rights and freedoms, Breteuil will inform the competent supervisory authority of this violation in accordance with the procedures provided for by applicable regulations.

It is the responsibility of users to exercise caution to prevent any unauthorised access to their Personal Data and in particular to their IT and digital devices (computer, smartphone, tablet in particular).

3.6. LINKS TO OTHER WEBSITES

The Site may occasionally contain links to sites of partners or third-party companies that have their own data protection policies.

Breteuil has no control over the content of these sites and disclaims all responsibility for the use of information collected when users click on these links.

Breteuil therefore invites users to review the data protection policies implemented by the publishers of these sites before transmitting any personal information to them.

3.7. USER RIGHTS

It is recalled that users have the following rights, subject to the limitations provided for by current legislation:

3.7.1. RIGHT TO INFORMATION ON PERSONAL DATA PROCESSING

Breteuil undertakes to use its best efforts to provide concise, transparent and accessible information on the conditions for processing users' Personal Data.

3.7.2. RIGHT OF ACCESS TO PERSONAL DATA

Each user may access the Personal Data being processed by Breteuil and has the right to receive a copy in electronic form (for any additional copy, Breteuil will be entitled to charge fees based on the administrative costs incurred).

3.7.3. RIGHT TO ERASURE ("RIGHT TO BE FORGOTTEN") AND RECTIFICATION OF PERSONAL DATA

Each user has the right to request the deletion and/or rectification of Personal Data concerning them when such data is inaccurate or outdated.

It is specified that Breteuil may retain certain Personal Data when the law requires it or in the case of a legitimate reason.

3.7.4. RIGHT TO OBJECT

Users may object at any time for legitimate reasons:

to the use of their Personal Data for direct marketing purposes

to the reuse of their Personal Data for processing other than that consented to, except in the case of Breteuil fulfilling one of its legal obligations.

3.7.5. RIGHT TO RESTRICTION OF PERSONAL DATA PROCESSING

Users have the right to request that processing carried out on their Personal Data be limited to what is necessary. This right is applicable only:

if the user contests the accuracy of their Personal Data

if the user can establish that the processing of their Personal Data is unlawful and requests a restriction of their use rather than erasure

if Breteuil no longer needs the user's Personal Data but it is still necessary for the user for the establishment, exercise or defence of legal claims

if the user objects to processing based on the legitimate interest of the data controller, pending verification as to whether the legitimate grounds pursued by the data controller override those of the user.

3.7.6. RIGHT TO LODGE A COMPLAINT WITH A SUPERVISORY AUTHORITY

If users consider that the efforts made by Breteuil to preserve the confidentiality of Personal Data do not guarantee respect for their rights, they have the possibility of lodging a complaint with the competent supervisory authority (CNIL or any other authority listed by the European Commission).

3.7.7. RIGHT TO DATA PORTABILITY

Users have a right to the portability of their data, authorising them to obtain from Breteuil their Personal Data in a structured, commonly used and machine-readable format and to request that this Personal Data be transmitted to another data controller.

3.7.8. RIGHT TO DECIDE THE FATE OF PERSONAL DATA AFTER DEATH

Users also have the right to organise the fate of their Personal Data after their death by adopting general or specific directives that Breteuil undertakes to respect.

In the absence of such directives, Breteuil recognises the heirs' ability to exercise certain rights, in particular the right of access if necessary for the settlement of the deceased's estate and the right to object.

3.7.9. CONDITIONS FOR EXERCISING RIGHTS

To exercise their rights, users are invited to contact the Breteuil Personal Data Protection Officer according to the procedures described in Article 5.

It is specified that to assist them in exercising their rights, the CNIL provides template letters on its website (www.cnil.fr). Before processing users' request(s), Breteuil may verify their identity by requesting proof of identity.

If necessary, this period may be extended by two (2) additional months given the complexity and number of requests, Breteuil then undertaking to inform users of the extension and the reasons for the delay.

3.8. AMENDMENT OF THE PERSONAL DATA PROTECTION CHARTER

Breteuil reserves the right to make changes to this Personal Data Protection Charter at any time in order to comply with legislative and regulatory developments and/or to improve its Personal Data processing and protection policy.

In the event of a modification, a new version will be updated and posted online with the "Last updated" date.

ARTICLE 4. APPLICABLE LAW AND COMPETENT COURT

This Charter is subject to French law, including the applicable provisions of private international law rules. In the absence of an amicable agreement, jurisdiction is given to the Paris courts notwithstanding multiple defendants and/or third-party proceedings to hear any dispute relating to the use of the site and/or the validity, execution and interpretation of these terms.

ARTICLE 7. SITE AVAILABILITY

You are informed that the Breteuil Site is accessible 24 hours a day, 7 days a week, except in cases of force majeure, IT difficulties, difficulties related to telecommunications networks or technical difficulties.

For maintenance reasons, Breteuil may interrupt access to the site.
